Terms of Service.

1. When you purchase something from Senior Studios you automatically agree to the Terms of Service.

 

2. You are not allowed to claim or copy any of Senior Studios's work as your own, nor copy any of our documents.

3. We require a 100% upfront payment for live work but 50% for a normal work.

4. All payments must go through Senior Studios payment system.

5. You may not sell any product made by a Senior Studios freelancer, without explicit permission to do so.

 

6. We keep all files saved, but we advise you to keep backups.

 

7. We keep track of all payments being made through Senior Studios.

 

8. We reserve the right to deny or terminate service if it is in breach of our Terms, or any laws set forth by any nations involved with the sale. We also reserve the right to deny or terminate service that we are not comfortable with terms surrounding, or developments not made clear before the service has begun.

9. We reserve the right to use any completed project on our social media, or portfolio, unless agreed on otherwise, you can find more information about this in the full document.

 

10. We have a strict no refund policy! unless certain requirements are met, more info can be found down below.

11. All Scam reports must go directly to the freelancer completing the job. If you feel like Senior Studios is involved please tag us in the Scam Report and we will reply within 48 hours. We are not responsible for any payments sent to the freelancer.

12. You must always follow our rules, if you violate them you may be banned, any active orders will NOT be refunded, for more information you can check our rules in #rules and on our website. for more information you can read our full terms of service in the document listed below and on our website.

 

13. You as the client pay an additional fee, a handling fee, of 10% up until $1000 USD and 6% for commissions above which is automatically added when your invoice is created.

14. If you as a client do not respond in over two weeks, the commission will be marked as complete and archived.

15. When a new freelancer is set to the commission, the commission is registered as a new commission which means that the previous details, quotes, deadlines, etc are no longer valid and new details must be discussed and must be agreed by the new freelancer.

16. You shall not assume you are entitled to features unless mentioned. E.g. source files.

Refund Policy.

We may give refunds in the following circumstances up to 75%. The refund is calculated on the total commission price.

1. Missed deadline (10% refund per day up to 75%)

2. Unsatisfactory product (to a maximum of 15%)

3. Substandard product (to a maximum of 35%)

As a client, you are not eligible for a refund if the delay is caused directly by you or by any third-parties or situations which are out of our control and restrict our capability to complete the commission. 

Commissions on hold: You have the option for keeping your commission on hold, this means a commission is declared as "on hold" by you, this duration will not be counted within deadline/timeframe and you will not be eligible for "missed deadline" refunds for the time period the commission was on hold.

 

Moreover, you are not eligible for a refund if you decide to cancel the commission after the freelancer already starts working on it, though a refund compensation may be issued in some cases, for the work which is yet to be completed. 

This is up to the discretion of the Department Lead of the department in question, in conjunction with that of the Management and Owner. There is an exception to this policy in the case of a Department Lead performing the service, in which case the decision will be left with Management and the Owner.

Extra charging policy.

We may charge extra under the following circumstances:


1. Client change of mind
2. Change in product when at least 50% complete
3. Addon to a project

This is up to the discretion of the Freelancer in question, in conjunction with that of the Management and Owner. There is an exception to this policy in the case of a Department Lead performing the service, in which case the decision will be left with Management and the Owner.

Information collection


We may collect information about the Services you use and how you use them, such as the selections you make on our Services. We collect PII, DII, and log information about your interactions for more information about this you can check our full legal documentation in the document listed below.
How we use the information we collect
We use the information we collect from our Services to provide, maintain, protect and improve our Services, to develop new Services and offerings, and to protect us and our users.

 

What we use the information we collect for
PII is primarily used for business purposes, such as for sending you occasional newsletters and updates, hiring, responding to inquiries, logins, and providing Services. When you contact us, we may keep a record of your communication as well as the other information to help solve any issues you might be facing. We may use your email address to inform you about our Services, such as letting you know about changes or improvements. Please keep in mind that comments sections, forums, and other similar areas of our Services are public. Any information posted in those areas is viewable and usable by anyone that has access.

 

Information Security


We work hard to protect our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold and undertake reasonable security measures with appropriate confidentiality, integrity, and availability protections. However, since no software or storage system is 100% secure, we cannot guarantee the security of your information associated with the Services, or any other service for that matter. You can help protect your account information by using unique and hard-to-guess passwords.

Terms of Service

 

General

 

Please read the following agreement. You will not be allowed to purchase anything from our services if you do not agree with our Terms of Service. It is up to you as a client of Senior Studios to check these Terms regularly as we reserve the right to change them at any time with or without notice.

 

Copyright

 

You may not copy any of our services or documents, you are also not allowed to claim any of the work provided by a Senior Studios freelancer as your own. If you do so, a scam report shall be opened against you; in serious cases, we are allowed to take legal actions against you.

 

Services

 

Our services are run by our Management team, If you require our freelancers to sign a NDA you will need to notify our management team, so we are able to choose a freelancer that is legally allowed to sign such an Agreement.

 

We require a 50% upfront payment for security reasons. This allows our Freelancer(s) to begin work on your project and to secure some payment in the event that the full amount is not paid. This document will be shown in case of a chargeback.

 

You as the client are required to pay a handling fee of 10% up until $1000 USD and 6% for commissions above, the fee is automatically added when the invoice is made. 

All payments must go through Senior Studios payment system, run by reputable payment platform, FastSpring. 

 

If we fail to retrieve the payment, we will claim the work as Senior Studios’s own and we will resell it to make up for the lost revenue. 

 

We may reject any commission for any reason we may find.

You shall not assume you are entitled to features unless mentioned. E.g. source files. 

Change of freelancer

When a new freelancer is set to the commission, The commission is registered as a new commission which means that the previous details, quotes, deadlines, etc are no longer valid and new details must be discussed and must be agreed by the new freelancer.

Service Copyright

All Products or Services provided by a Senior Studios Freelancer may not be sold without explicit permission prior to the sale, and any arrangements made in part with this agreement fulfilled. Any Products or Services discovered to have been resold will immediately be claimed as Senior Studios property and we reserve the right to pursue any legal recourse that we deem fit. 

 

Project Files

 

We keep project files saved on our archive website, however we advise you to keep backups as we will not be responsible for any data or product loss.

 

Logging

 

We keep a record of all transactions for our records. These records may include information such as emails and usernames. This information will not be made public, nor sold to any outside entity.

 

Cancellation

 

We reserve the right to deny or terminate service if it is in breach of our Terms, or any laws set forth by any nations involved with the sale. We also reserve the right to deny or terminate service that we are not comfortable with terms surrounding, or developments not made clear before the service has begun.

 

Portfolio

 

We reserve the right to use any completed project for our own promotional uses and/or in our portfolio. This product may include a small description. We will not use your name or information unless explicitly allowed.

 

Refunds

 

We have a strict no refund policy. Once a project has started, we will not issue a refund. unless your product meets the following criteria See our Refund Policy​  for full information​. The refund is calculated on the total commission price.

         

Scam Reports

 

All Scam reports must go directly to the freelancer completing the job. If you feel like Senior Studios is involved please tag us in the Scam Report and we will reply within 48 hours. We are not responsible for any payments sent to the freelancer.

Rules

The following rules must be followed under any circumstances, if you break one of these rules or regulations, you will be banned, if you have any open orders, they will not be refunded. You can find the rules in the #rules channel in our discord and on our website.

 

Language used in tickets

We understand that English is not everyone's primary language and not everyone is fluent in it. 

This is why we hire freelancers who speak different languages. However since its not easy to get trusted QC staff for all languages, we do not encourage our freelancers to not talk in any other languages than English. 
However, if you talk to freelancer in any other languages than English, you must take responsibility of the quality ticket and acknowledge that the management will be helpless if you face any quality control issues. Senior Studios is not responsible for any promises done by Freelancer in any other languages than English which they fail to fulfill. 

Refund policy

We can give refunds in the following circumstances up to 75%:

 

Missed Deadline 

If a product is not completed on or before the deadline, we may give a partial refund following 10% per day up to 75% of the commission’s price depending on the amount of time allowed, any changes requested by the client, and the size of the job. We evaluate each incident on a case by case basis.

 

Unsatisfactory product 

If a client is not happy with the product provided, we may give a refund of a maximum of 15%, and the product will be fixed to the customer’s standards. This is only when the request is marginal, and if the requests were outlined in the original agreement.

 

Sub-Standard Product 

If a project is under the standards of Senior Studios we may give a refund equalling a maximum of 35%. This is up to the discretion of the Department Lead of the department in question, in conjunction with that of the Management and Owner. There is an exception to this policy in the case of a Department Lead performing the service, in which case the decision will be left with Management and the Owner.

 

Open Clause 

We may offer a refund for reasons other than those outlined in this document. In cases such as these, it will be entirely up to the discretion of the Management and/or the Owner.

Handling fees are non-refundable.

The refund % is on the total decided amount.

As a client, you are not eligible for a refund if the delay is caused directly by you or by any third-parties or situations which are out of our control and restrict our capability to complete the commission.

 

Moreover, you are not eligible for a refund if you decide to cancel the commission after the freelancer already starts working on it, though a refund compensation may be issued in some cases, for the work which is yet to be completed.

Commissions on hold

You have the option for keeping your commission on hold, this means a commission is declared as "on hold" by you, this duration will not be counted within deadline/timeframe and you will not be eligible for "missed deadline" refunds for the time period the commission was on hold.

Extra charging policy:

In the event that a client wishes to alter the commission, you are entitled to charge extra.

Ensure that all details are clear to all parties involved and then tag your Department Leader, Manager, and/or Owner. One of those three parties must also provide approval to the price increase.

 

In the event that one of those parties is acting as the Freelancer performing the service, they are unable to provide approval and one of the other parties will need to provide instead.

All requests must be inside the official discord server ticket, any requests by client outside of ticket won't be considered in the eyes of Senior Studios.

 

Change in product when at least 50% complete

If a considerable change to the project is requested after the original request has reached 50% completion, you may also ask for a price increase. In this case the original 50% paid will be kept, and you may issue a new quote.

 

In the event that one of those parties is acting as the Freelancer performing the service, they are unable to provide approval and one of the other parties will need to provide instead.

 

Addon to the project 

If the client wishes to add an additional service or add a request not present in the original agreement as is not relevant to an issue resulting from work done or an issue with the product, you are entitled to asking for additional pay. A Manager, or Owner will need to provide approval for this.

 

In the event that one of those parties is acting as the Freelancer performing the service, they are unable to provide approval and one of the other parties will need to provide instead.

 

Open Clause 

You may require additional payment for reasons other than those outlined in this document. In cases such as these, it will be entirely up to the discretion of the Freelancer and Management.

Privacy policy

 

This privacy policy will explain what information we collect online, why we collect it, and the choices we offer to you.

 

Information Collection 

We may collect information about the Services you use and how you use them, such as the selections you make on our Services. We collect PII, DII, and log information about your interactions as described below.

 

Personally Identifiable information (PII)  

This is information that can be used to identify or contact you online or offline, such as your name, address, email, phone number, photos or audio data, and payment information. The Services may collect PII when it is provided to us, such as when you use our Services, attempt to contact us, submit a resume, volunteer, or job application, or connect with us on social media or one of our partners. 

 

Device Identifiable information (DII)

 Such as cookies, unique device and advertising identifiers, usernames, and similar identifiers that are linkable to a browser or device. From these platforms, we may also receive other information, such as your IP address, user agent, timestamps, precise and imprecise geolocation, sensor data, apps, fonts, battery life information, and screen size.

 

Other 

Our Services also collect information about your interactions, including navigation paths, search queries, crashes, timestamps, purchases, clicks and shares, and referral URLs. We may combine this data with PII and DII. For efficiency’s sake, information about your interactions may be transmitted to our services while you are not using the app or on our website. We may also partner with third parties that collect additional information – please see their privacy policies for more details and see below for your choices regarding these parties.

 

How we use information we collect

We use the information we collect from our Services to provide, maintain, protect and improve our Services, to develop new Services and offerings, and to protect us and our users.

  3. For external processing - We provide PII to our affiliates or other trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures. 

  4. For legal reasons - We will share PII with companies, outside organizations or individuals if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable law, regulation, legal process or enforceable governmental request, detect, prevent, or otherwise address fraud, security or technical issues or protect against harm to the rights, property or safety of our users or the public as required or permitted by law. 

  5. In case of a sale or asset transfer - If we become involved in a merger, acquisition or other transaction involving the sale of some or all of our assets, user information, including PII collected from you through your use of our Services, could be included in the transferred assets. Should such an event occur, we will use reasonable means to notify you, either through email and/or a prominent notice on the Services. 

  6. In aggregated form for business purposes - We may share aggregated information and DII with our partners such as businesses we have a relationship with, advertisers or connected sites. For example, we may share information to show trends about the general use of our Services. 

  7. We use DII to operate our Services and manage user sessions, including analyzing usage of our Services, preventing malicious behavior and fraud, improving the content, to link your identity across devices and browsers in order to provide you with a more seamless experience online, and helping third parties provide relevant advertising and related metrics. We share DII with third parties primarily for advertising and analytics purposes, for external processing, and for security purposes.

 

Third Parties 

While we strive to work with reputable companies with good privacy practices, this Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you on the Services. We also do not control the privacy policies and your privacy settings on third-party sites, including social networks. We may use third parties to help offer you more tailored ads and better Services, such as obtaining analytics about the users of our site and to help tailor advertising to your preferences. Recommendations  

Any external services offered/recommended by the Freelancers and Staff of Senior Studios is their own recommendation. Senior Studios is not responsible for any fraud or problems you are have with service providers who are not directly affiliated with Senior Studios. Use the services recommended by anyone inside Senior Studios at your own risk. External Services are the services which are not directly offered by Senior Studios, this includes but is not limited to: Hosting Solutions, Licenses for products, etc. You can view our official partners and affiliates in at our partners page.

 

 

Choice 

If you wish to cancel or delete your account, you can do so by accessing our platform or contacting us for assistance with the process. Our email is included at the end of the privacy policy.

 

Accessing and updating your information 

We aim to provide you with reasonable opportunity to access, update, and delete to your PII. In some cases, we may have to keep that information for legitimate business or legal purposes. When updating your information, we may ask you to verify your identity before we can act on your request.

Attempting to evade Senior Studios premises.  

You as a client will not contact our freelancers through direct messages about a commission. All communication between you and the freelancer must be in a ticket. If you are found making a private transaction with a freelancer found through Senior Studios, you will be banned from using any of our services, from our discord and will be ineligible to claim any refunds. Your archived tickets will still be viewable via our archive panel. If you need to contact a freelancer regarding a product that was created through Senior Studios, please open a support ticket and the freelancer will speak with you in the ticket.

Senior Studios is also not responsible for any money lost/scammed, which was directly paid to the freelancer.

 

Information security 

We work hard to protect our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold and undertake reasonable security measures with appropriate confidentiality, integrity, and availability protections. However, since no software or storage system is 100% secure, we cannot guarantee the security of your information associated with the Services, or any other service for that matter. You can help protect your account information by using unique and hard-to-guess passwords.

Right to contact

Under the circumstance in which you provide any information, by possible means of; an order, contact request, newsletter, etc., you are providing the unwritten confirmation that you are providing us the right for you to be contacted via the provided information. You understand that as you are providing this information on your own behalf; therefore, you are not subject to any compensation for the reception of the reasons which we may deem there is the need to contact you. If you wish to remove the ability to receive the newsletter or marketing notices - as in discounts and giveaways, you are to do so by unsubscribing from said newsletter and marketing notices. However, please note that you may still receive contacts of already scheduled newsletters and marketing notices, or contacts for other reasons - aside from the newsletters and marketing notices. In order to ensure all contacts are successfully received, we request that under no circumstance do you block or report the accounts which we will use to contact you.

30 day support

We offer a 30 day support period on our services where you can get free support on the services free of charge.

Please keep in mind that:

1. 30 day support period is simply a 30 day extension to your ticket where you can get help, or get product fixes until the point it matches the originally agreed specifications. If you request extra changes in this period, you can be charged under extra charging policy.

 

2. Support means help with your products and answering questions about it, freelancer will be answerable to you in case of any issues or problems with the product or service.

 

3. Performing changes requested on a product are at the freelancer's discretion and can be denied or be additionally charged if freelancer desires.

 

4. Asking for anything which was not specified in original request/brief or changing mind on a section of product will be classified as change and freelancer can charge extra based on our extra charging policy.

 

5. If the product does not match the originally mentioned and agreed details, you can get changes in the 30 day period.

 

6. Extra charging policy applies in the support period, if your request falls under extra charging policy, you can be charged extra.

 

Children Under 13 

We do not knowingly collect information for any child under the age of 13. If you are the parent of a child under the age of 13 and have a concern regarding your child’s information on our Services, please contact us in our Senior Studios Discord server.

 

Our Services are Located in Sweden 

Our Services are directed to European citizens. If you are outside of Europe, your information will be processed and stored in Sweden and you are consenting to such transfer, processing, and storage under the laws of Sweden and Europe.

 

Changes 

Our Privacy Policy may change from time to time. We will post any Policy changes on this page, including material changes. Please check back periodically to view changes to our privacy policy.
